Biography

Murad is a partner in the Healthcare, Litigation & Dispute Resolution, Government Investigations, and International Trade practices. He represents healthcare providers, life sciences companies, multinational businesses, and others in government investigations, False Claims Act (“FCA”) litigation, white collar criminal matters, regulatory enforcement actions, and complex disputes. He also serves as AGG’s chair of Foreign Agents Registration Act (“FARA”) Compliance. Murad combines seasoned trial and investigations experience with business-focused counsel to protect and advance clients’ operations, reputations, and long-term objectives.

Clients turn to Murad when facing high-stakes investigations and audits by the U.S. Department of Justice (“DOJ”), the U.S. Department of Health and Human Services Office of Inspector General (“HHS-OIG”), the Centers for Medicare and Medicaid Services (“CMS”), state attorneys general, and other federal and state regulators. His practice is distinguished by two complementary areas: defending healthcare providers and life sciences companies in government investigations, FCA qui tam suits, and Medicare disputes, and representing domestic and international clients in cross-border enforcement, compliance, and litigation matters. Murad regularly counsels clients on matters involving alleged criminal and civil healthcare fraud, the Anti-Kickback Statute, export controls, customs and tariff laws, and FARA. Across his practice, Murad has successfully defended his clients in federal criminal jury trials, won dismissals of FCA lawsuits, negotiated declinations and other favorable resolutions of complex government investigations and litigation, and brought affirmative litigation against the government to vindicate his clients’ rights.

Murad is a committed advocate for healthcare providers nationwide, including individual physicians, medical practices, hospital systems, life sciences companies, and executives. He has deep experience defending practitioners in specialties receiving heightened scrutiny by CMS, HHS-OIG, and DOJ, including outpatient interventional cardiology and interventional radiology, Mohs surgery, wound care, and ophthalmology. Murad also helps clients strengthen their compliance programs by advising on emerging enforcement trends, including the government’s growing use of artificial intelligence, data analytics, and statistical modeling to target billing and reimbursement patterns.

Murad’s cross-border enforcement practice complements his healthcare work, reflecting the increasingly global and multidisciplinary nature of government investigations. As AGG’s chair of FARA Compliance, he advises multinational companies, investors, foreign-funded U.S. entities, and other cross-border operators on evolving U.S. regulatory requirements and enforcement trends involving FARA, export controls, sanctions, and customs and tariff laws, and represents them in related government investigations.

  • Represents and advises healthcare providers specializing in cardiology, vascular surgery, interventional radiology, wound care, dermatology, ophthalmology, and other areas in civil FCA investigations and qui tam litigation, criminal healthcare fraud investigations, and Medicare audits involving the DOJ, HHS-OIG, CMS, and Medicare contractors, as well as in regulatory compliance and corporate strategy.*
  • Represents pharmaceutical companies in administrative litigation challenging Medicare Part D discount program civil monetary penalty determinations and negotiating favorable nuisance-value no-fault settlements.*
  • Represented two Pennsylvania outpatient interventional cardiology practices in winning dismissals with prejudice of two FCA qui tam lawsuits concerning state facility licensing requirements, and securing affirmance by the U.S. Court of Appeals for the Third Circuit. See, e.g., U.S. ex rel. Stebbins v. Maraposa Surgical, Inc., No. 24-1626, 2024 WL 4947274 (3d Cir. Dec. 3, 2024).*
  • Represented pharmaceutical innovators in winning dismissals of two FCA qui tam lawsuits arising from drug promotional activities, litigating related federal and state appeals, and negotiating favorable resolutions of parallel state attorney general consumer protection actions.*
  • Represented an ophthalmic surgeon in a federal criminal bribery prosecution, obtaining a mistrial after the jury deadlocked, and winning a Rule 29 dismissal of key counts, which led the prosecution to dismiss all remaining charges. U.S. v. Menendez, et al., 291 F. Supp. 3d 606, 623-35 (D.N.J. 2018).*
  • Represented a national hospital management company in federal investigations, proceedings before the Judicial Panel on Multi-District Litigation, and multiple nationwide FCA qui tam lawsuits alleging medically unnecessary emergency department services and physician kickbacks, as well as in related state court litigation.
  • Represented a Mohs surgeon in winning a complete acquittal following a five-week federal criminal healthcare fraud jury trial in the U.S. District Court for the Eastern District of Virginia.*
    • Represents Yangtze Memory Technologies Co., Ltd. (YMTC) as lead counsel in ongoing federal litigation challenging the company’s placement on the U.S. Department of Commerce’s Entity List and seeking related records under the Freedom of Information Act (FOIA).
    • Advises international and domestic businesses, trade associations, nonprofits, philanthropic organizations, law firms, consulting firms, think tanks, and lobbyists on Foreign Agents Registration Act (FARA) and Lobbying Disclosure Act (LDA) compliance, including responses to DOJ inquiries.*
    • Represented Arrow Electronics, Inc. in securing the removal of its Chinese and Hong Kong subsidiaries from the U.S. Department of Commerce’s Entity List.*
    • Counseled multinational life sciences companies and other manufacturers on U.S. customs import compliance, Section 232 tariff investigations, and related FCA matters.*
    • Represented a biopharmaceutical company in conducting an internal investigation regarding Lacey Act compliance for research animal transactions.*
    • Represented a public official in a DOJ criminal FARA investigation that concluded without criminal charges, civil claims, or settlement.*
      • Represents the NAACP Virginia State Conference in student voting rights litigation against Virginia state and local election officials, and negotiated a consent decree with the Office of the Attorney General of Virginia.
      • Represented immigration detainees in habeas corpus challenges to mandatory immigration detention without bond.*
      • Represented indigent criminal defendants at trial, sentencing, and plea negotiations in U.S. Attorney’s Office prosecutions in the Superior Court of the District of Columbia.*
      • Represented a former FBI Deputy Director in his wrongful termination action against the U.S. Department of Justice and FBI under the First and Fifth Amendments, defeating the government’s dispositive motion, prevailing on a motion to compel discovery, and securing a settlement that fully restored the client’s retirement status and benefits. See McCabe v. Barr, et al., 490 F. Supp. 3d 198 (D.D.C. 2020).*
      • Represented an Islamic society in litigation under the Religious Land Use and Institutionalized Persons Act (RLUIPA), resulting in the issuance of a previously denied utilities permit through settlement.*
      • Represented individuals born in American Samoa in federal constitutional litigation seeking recognition of birthright U.S. citizenship under the Fourteenth Amendment.*
