Craig R. Smith

Partner

Biography

Craig is a partner in AGG’s Intellectual Property practice who helps technology companies protect the innovations that drive their businesses. For more than 30 years, companies ranging from startups to Fortune 50 businesses have turned to him for complex intellectual property litigation, and strategic guidance on how to build, protect, and derive value from their IP. His experience spans software and artificial intelligence, consumer products, biotechnology and medical devices, automotive technologies, and industrial and manufacturing systems.

Much of Craig’s litigation practice involves competitor-versus-competitor disputes, where the stakes extend well beyond the case itself. A patent, trade secret, trademark, or copyright dispute can affect whether a product remains on the market, how a company competes, and where it invests next. Craig approaches those matters with the broader business objective in mind, looking for opportunities to resolve disputes efficiently while preparing to take them through trial and appeal when necessary.

His strategic approach has produced significant results at every stage of litigation. Craig has obtained dismissal and summary judgment victories in high-stakes patent matters, including defeating claims seeking more than $2 billion in damages. His trial experience includes securing a jury verdict of noninfringement for a global software company in a case recognized by The National Law Journal among its top defense wins, as well as obtaining a final decision of non-infringement and patent invalidity for a chemical manufacturer following a seven-day trial before the International Trade Commission. He also has successfully handled patent appeals before the United States Court of Appeals for the Federal Circuit.

Craig’s role with clients often begins well before a dispute and continues as their businesses and intellectual property needs evolve. He helps technology companies make deliberate decisions about what to protect, where to invest, and how their patent and trademark portfolios can support broader commercial goals. His counseling includes licensing and technology agreements, intellectual property acquisitions and due diligence, pre-suit investigations, and proceedings before the U.S. Patent and Trademark Office, including inter partes review and reexamination. He also works proactively with legal and technical teams to safeguard confidential information and trade secrets before problems arise.

Craig brings an interdisciplinary technical perspective to his practice through his background in civil engineering and environmental engineering, including graduate studies focused on microbiology. This foundation helps him quickly understand technologies, work effectively with technical teams and experts, and translate complex concepts into clear legal and business strategies — a particularly valuable asset for companies covering a wide range of technologies and industries.
