Tucker Barr is a partner in the Litigation Practice and Intellectual Property Practice. Mr. Barr has a wide-ranging intellectual property practice, with a focus on trademark and advertising matters. As both an intellectual property attorney and an experienced litigator, Mr. Barr is able to help clients not only register and secure their intellectual property rights, but also take steps to aggressively enforce those rights when necessary.

Mr. Barr works with clients to identify, clear, and register their trademarks. His clients range from individuals and businesses with small trademark portfolios to multinational organizations with hundreds of trademark registrations. In addition to providing traditional trademark clearance, prosecution, and portfolio maintenance services, Mr. Barr provides strategic advice to help clients overcome trademark conflicts through brand transitions, consent agreements and licenses, and trademark purchases and assignments. Mr. Barr guides start-up companies and entrepreneurs, who often have little or no experience with trademarks, and helps them build lasting portfolios. For more established businesses, Mr. Barr develops brand usage guidelines and internal policies to facilitate the identification and protection of intellectual property. Mr. Barr tailors each aspect of his trademark practice to match the client’s the short-term opportunities and vulnerabilities, long-term objectives, and budget.

Mr. Barr also advises advertising agencies, publishers, quick service restaurants (QSRs) and fast-casual restaurants (FCRs), retail chains and franchises, and other businesses on a range of marketing and advertising issues. Mr. Barr reviews his clients’ social media campaigns, advertising, and promotional materials to ensure compliance with applicable laws and internal brand guidelines and to avoid infringement of the copyrights, trademark rights, and publicity rights of others. Mr. Barr also assists clients with the licensing of photos, music, publicity rights, and other intellectual property for use in connection with his clients’ advertising and promotions. Mr. Barr provides these advertising services both to clients who have a need for an ongoing, structured legal review program, and also on an as needed basis to clients who are rolling out new products or campaigns.

Mr. Barr also counsels clients on Internet and domain name matters, including domain conflict dispute resolution, domain portfolio management, and the implementation of defensive domain registration strategies in response to the release of new generic top-level domains (gTLDs). Mr. Barr also helps clients develop programs to identify and stop infringement on social media and online auction sites.

Mr. Barr’s litigation practice focuses on prosecuting and defending intellectual property claims, restrictive covenant and trade secret claims, and general commercial disputes. In addition to actions in state and federal courts, Mr. Barr litigates trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board (TTAB). Mr. Barr also represents plaintiffs and defendants in false advertising litigation.

Prior to attending law school, Mr. Barr played professional baseball with the Houston Astros organization, and draws upon this experience in his representation of professional athletes and sports agents.
