Tucker Barr is a partner in the Litigation Practice and Intellectual Property Practice. Mr. Barr has a wide-ranging practice, focusing on trademarks, intellectual property litigation, and technology-related contracts.

Mr. Barr works with clients to identify, clear, and register their trademarks. His clients range from individuals and businesses with small trademark portfolios to multinational organizations with hundreds of trademark registrations. In addition to providing traditional trademark clearance, prosecution, and portfolio maintenance services, Mr. Barr provides strategic advice to help clients overcome trademark conflicts through brand transitions, consent agreements and licenses, and trademark purchases and assignments. Mr. Barr guides start-up companies and entrepreneurs, who often have little or no experience with trademarks, and helps them build lasting portfolios.

Mr. Barr also drafts and negotiates a wide variety of complex contracts with particular emphasis on technology agreements, software licensing, procurement contracts, SaaS agreements, and professional services agreements. Mr. Barr has extensive experience assisting foreign technology companies with these matters.

Mr. Barr’s litigation practice focuses on prosecuting and defending intellectual property claims, restrictive covenant and trade secret claims, and general commercial disputes. In addition to actions in state and federal courts, Mr. Barr litigates trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board (TTAB). Mr. Barr also represents plaintiffs and defendants in false advertising litigation.

Mr. Barr also advises advertising agencies, publishers, quick service restaurants (QSRs) and fast-casual restaurants (FCRs), retail chains and franchises, and other businesses on marketing and advertising issues. Mr. Barr reviews his clients’ social media campaigns, advertising, and promotional materials to ensure compliance with applicable laws and internal brand guidelines and to avoid infringement of the copyrights, trademark rights, and publicity rights of others.

Prior to attending law school, Mr. Barr played professional baseball with the Houston Astros organization and draws upon this experience as the Co-Chair of the firm’s Sports and Entertainment Industry Team.
