We seek to partner with our clients throughout the course of a project to assist with issues that may arise during the design, bidding, construction, payment, and completion phases, as well as assisting with any disputes that may arise during construction or following completion through mediation, arbitration, or litigation.

Overview

Our Construction law practice focuses on drafting and negotiating architect agreements, construction contracts, design-build agreements, engineering contracts, and construction management contracts for matters of varying size and scope. We primarily represent developers, owners, and tenants in connection with various types of projects, including out-of-the-ground new construction, renovations, tenant improvement build-outs, outparcel development, multi-floor building renovations, single buildings, and multi-building apartment complexes. Often we advise on the coordination of design and construction goals with interrelated environmental, soil management, zoning, public investment, lease, and other requirements. We have experience with industry-standard documents, such as American Institute of Architects (AIA) documents and custom-tailored forms. We have worked in all industry sectors, such as multi-family, retail, industrial, office, mixed-use, and roadway and infrastructure.

Experience

  • Representation of a variety of developers in the development, design, construction, and financing of affordable housing projects in compliance with the requirements of the Department of Housing and Urban Development, various Housing Authorities, other interested governmental agencies, lenders, and investors.
  • Representation of retail stores and landlords for the design and construction of tenant improvements in stand-alone locations and malls, including allocating payment responsibilities among the landlords, lenders, and tenants throughout the construction process.
  • Representation of businesses in the renovation of office space, including the remodeling of multiple floors to be completed in sequential order and the conversion of ground floor space into retail units.
  • Representation of a developer in the design-build of self-storage facilities across numerous jurisdictions.
  • Representation of the Atlanta Beltline Partnership in connection with the design-build of the Westside Park at Bellwood Quarry, including coordination with and allocation of responsibility among the Atlanta Beltline, Inc., the City of Atlanta, the Beltline TAD, and the Arthur M. Blank Family Foundation.
  • Drafted template general construction and design-build contract forms for the largest non-foods specialty distributor in the U.S. for use in “small” construction projects, providing numerous optional provisions depending on the specific circumstances of the project’s scope.
