Civil Rights and False Claims Act Risk & Response Team
Overview
In response to the U.S. Department of Justice’s Civil Rights Fraud Initiative, which expands the False Claims Act (“FCA”) to cover alleged violations of diversity, equity, and inclusion (“DEI”) policies, AGG has launched a dedicated Civil Rights and False Claims Act Risk & Response Team. This cross-disciplinary team draws from AGG’s deep experience in False Claims Act defense, government investigations, employment law, federal grants and contracts, and compliance audits to help federal funding recipients assess and mitigate risk under the new enforcement initiative.
As of May 2025, the DOJ has made clear that certain race- and gender-based DEI programs may now be treated as actionable “fraud” under the FCA. This novel enforcement theory puts a wide range of federal funding recipients — including universities and other educations institutions, healthcare systems, nonprofits, and contractors — at risk of whistleblower complaints, DOJ scrutiny, and FCA litigation. Importantly, these risks are no longer confined to financial misstatements but extend to alleged noncompliance with civil rights requirements.

- Advised a large public company in a $100+ million FCA investigation concerning defense contracts for goods supplied to the U.S. military, including internal investigation, strategy development, and presentation to government authorities, culminating in a favorable settlement.
- Conducted multiple internal investigations for healthcare systems, medical practices, and corporate boards in response to complaints of racial discrimination, gender bias, or sexual harassment involving senior executives. Guided organizational response and compliance strategy to mitigate legal exposure.
- Represented educational and healthcare institutions in DOJ civil investigations concerning alleged noncompliance with documentation and certification requirements tied to federal funding.
- Successfully defended a company in an age discrimination suit arising from a large-scale workforce restructuring. Conducted risk assessment, managed restructuring planning and training, and secured summary judgment, later affirmed on appeal.
- Counseled corporate boards and in-house legal departments during parallel civil and criminal DOJ investigations involving civil rights allegations, anti-kickback statutes, and government reimbursement claims.
- Guided a regional energy provider through an internal investigation of gender discrimination allegations, coordinating with in-house ethics and compliance teams to assess risk and implement recommendations.
