Affordable Housing Providers Have a Legal Responsibility to Know How Their AI Tech Works

AGG Privacy & Cybersecurity attorneys Kevin Coy and Kelley Chandler published an article for Multifamily & Affordable Housing Business discussing how important it is for affordable housing providers to be knowledgeable of the artificial intelligence (“AI”) tools at their disposal.

Kevin and Kelley noted that the December 11 executive order, “Ensuring a National Policy Framework for Artificial Intelligence,” intends to withhold certain federal funding from states that pass laws that the administration decides are burdensome. They also explained how some states are creating their own AI and consumer privacy laws, and these laws could result in consequences for housing providers and their vendors.

Affordable housing operators should “conduct thorough vendor diligence . . . including the resources used to develop an AI system or the source of the AI license,” Kevin and Kelley wrote. They added that documentation of AI tool usage and privacy practices, particularly where required by law, will also be key.
