Recognition and Enforcement of International Arbitration Awards

Overview

AGG represents clients in U.S. federal courts in matters arising from international arbitration proceedings, including:

  • The recognition and enforcement of foreign arbitral awards under the International Centre for Settlement of Investment Disputes (“ICSID”), New York Convention, and Panama Convention.
  • The recognition and enforcement of foreign arbitral awards involving the U.S. Foreign Sovereign Immunities Act (“FSIA”).
  • Actions to compel, stay, or enjoin arbitration.
  • Obtaining interim relief during the pendency of international arbitration proceedings.
  • Obtaining evidence for use in international arbitration proceedings, including experience with 28 U.S.C. § 1782.

Experience

  • Represented the Kingdom of Spain in four separate U.S. federal court proceedings defending against enforcement of ICSID and Stockholm Chamber of Commerce awards totaling more than €268 million.*
  • Represented a Ukrainian energy supply company in award recognition proceedings against the Republic of Moldova arising from breach of Energy Charter Treaty obligations.*
  • Successfully represented a Russian company in New York Convention enforcement proceedings in Seattle, obtaining recognition and enforcement of a Moscow-based MKAS award and collecting the resulting judgment.*
