- Simple one-page handouts titled something like “How We Use Technology to Support Your Care Team.”
- Documentation of the patient’s or representative’s response in the clinical record.
- An update when a new AI capability is introduced (e.g., switching to an ambient scribe or activating a predictive decline model), along with a brief revisitation of the conversation and any noted consent or objections.

In an industry built on intimacy and trust, that is a risk no provider can afford. For fealty to the CoPs, if AI is touching the plan of care in any meaningful way, the patient must be invited to the table as a full partner in that decision too. A simple, consistent, documented disclosure protocol is no longer optional. Instead, it is the new price of admission for responsible AI adoption in home health and hospice.

By 2026, CMS’ expanded use of AI in prior authorization, new state “high-risk AI” registries, and FDA’s maturing lifecycle oversight of adaptive algorithms will add still more complexity.
