Experience

  • Secured judgment on the pleading for a national food retailer in a dispute concerning calculation of a termination fee where the landlord refused to terminate the lease in accordance with the early termination provision unless the tenant paid nearly double the required amount.
  • Represented a national movie theater in a class action lawsuit regarding a newly enacted New York State consumer protection law for online movie ticket purchases.
  • Served as counsel to a national real estate development company and secured a favorable settlement in condemnation proceeding.
  • Served as counsel to a restaurateur in a land use dispute and secured necessary easements to protect the restaurant’s planned construction and subsequent operations.
  • Defeated motion for summary judgement brought by landlord in lease dispute.
  • Successfully preserved a restaurant tenant’s lease rights in an ongoing dispute in the Superior Court of Fulton County, Georgia. Defeated a motion for summary judgment by establishing that alleged “oral leases” were enforceable amendments to a prior written lease, supported by the client’s part performance under Georgia’s Statute of Frauds exception. The court denied the landlord’s motion, allowing the client to remain on the property.
  • Successfully defended a restaurant chain in a breach of contract action in the Georgia State-Wide Business Court involving complex lease termination issues and a claim for over $1 million in damages. Before discovery commenced, obtained judgment on the pleadings and an award of attorneys’ fees, securing a swift and complete victory.
