Benjamin D. Perkins
Associate
Suite 2100
Biography
Ben is an associate in the Litigation & Dispute Resolution practice group, representing businesses throughout the country, ranging from startups to Fortune 500 companies. He litigates disputes involving intellectual property assets, as well as other complex issues businesses regularly encounter.
Companies often turn to Ben to defend them against allegations of intellectual property misappropriation; infringement; and misuse involving patents, trademarks, copyrights, trade secrets, and confidential information. In these matters, Ben works closely with clients to develop comprehensive defense strategies designed to minimize operational disruption, mitigate or eliminate potential damages, and protect companies’ goodwill and competitive position. As defense counsel, Ben has successfully opposed requests for injunctive relief, negotiated highly favorable settlements, and secured complete defense victories.
Ben also regularly represents businesses seeking to enforce and protect their intellectual property rights. He has been retained on several occasions to prosecute claims against former employees, competitors, and other bad actors who have improperly taken, misused, or infringed upon clients’ intellectual property. Ben aggressively pursues these claims and regularly seeks emergency injunctive relief to prevent ongoing harm to his clients. Through these efforts, Ben has rapidly secured the return of misappropriated information, stopped intellectual property infringement, and recovered substantial damages.
In addition to intellectual property disputes, Ben often litigates a broad range of business matters, including claims related to restrictive covenants and other contractual obligations, securities, fraud, defamation, breaches of fiduciary duties, and other business torts. He has represented clients before a variety of adjudicative forums, including state and federal courts, JAMS, the American Arbitration Association (“AAA”), the Trademark Trial and Appeal Board (“TTAB”), and other administrative agencies.
Ben is a member of the American Bar Association and previously participated in the Utah State Bar’s Leadership Academy. He also has volunteered with the Goldman Sachs 10,000 Small Businesses program, which supports the growth of small businesses across the country. Earlier in his career, Ben served as a judicial intern in the United States District Court for the Northern District of Georgia.
