Tampa Physician Sentenced to Prison for Obstructing Medicare Audit

On Friday, September 14, 2018, U.S. District Judge Steven Merryday for the Middle District of Florida sentenced Dr. John Janick of Port Charlotte to five months in prison and three years of supervised release, plus $118,831.62 for restitution to Medicare, for lying to Medicare program integrity contractors auditing his medical practice, Janick Medical Group.

According to a plea agreement, Dr. Janick pled guilty to obstructing a Medicare audit by falsely stating that a third-party was responsible for paying rent for office space utilized by his wife, Lisa Janick, within the Janick Medical Group practice offices. Mrs. Janick allegedly utilized the office space to unlawfully access patient data to generate referrals from the Janick Medical Group to her third-party employer.

Mrs. Janick also pled guilty to her involvement in this scheme in a related case and is set to be sentenced on October 10, 2018. In her plea agreement, Mrs. Janick agreed to plead guilty to falsifying patient records to obtain referrals from Janick Medical Group patients to her unidentified third-party employer.
