Legal Compliance Considerations for Websites and Website-Enhancing Technologies
AGG Privacy & Cybersecurity attorneys Kevin Coy, Erin Doyle, and Kelley Chandler co-authored an article in Intellectual Property & Technology Law Journal exploring the legal challenges associated with innovations that many companies use to support their customers’ experience on their websites including chatbots, third-party solutions, and online tracking technologies.
The attorneys also addressed the regulatory landscape related to websites and website-enhancing technologies, along with key jurisdictional differences in how these technologies are treated under laws that aim to give users control over their personal information collected during their website use sessions.
Based on the regulatory challenges for website and website-enhancing technologies, Kevin, Erin, and Kelley provided best practices for companies to employ such as compliance due diligence, obtaining consent for the collection of personal information, and maintaining clear and accurate disclosure of privacy policies. They also emphasize the importance of remaining mindful of laws surrounding personal data storage, data minimization, the potential for downstream uses not consented for, and data breach risk.
“In a world where both regulators and consumers are increasingly focused on privacy, companies should be aware of the changing legal landscape, assess jurisdictional differences, determine which laws apply to them, and ensure effective and compliant implementation of best practices to avoid legal and reputational harm,” they said.
