Clinton Yu Quoted in Bloomberg Law Sharing Insight on Increased Pressure for Importers to Share Federal Tariff Refunds

AGG partner and co-chair of the International Trade team and member of the Corporate & Finance practice, Clinton Yu, was quoted in an article for Bloomberg Law discussing how suppliers and customers are pressuring importers to share the federal tariff refunds recently approved by the Supreme Court.  

Clinton shared insight into the increase in suppliers and customers asking questions on business-to-business refund issues. “Refunds are starting to flow in. So now people are getting a little bit antsy: ‘Where’s my money?’” he said. 

“The vast majority of these companies didn’t have the foresight or just didn’t think they would need to have strong or specific contractual language to address this refund because they didn’t think the refunds were coming,” Clinton noted. “And who would? This is a very new issue.”  

Because of issues with the contractual language, “We’re really looking at a case-by-case basis: What does the contract actually say for these business-to-business issues?” shared Clinton.
