Clinton Yu Quoted in Bloomberg Law on Court Order Affecting Tariff Refunds

AGG International Trade co-chair and Corporate & Finance partner, Clinton Yu, was quoted in an article for Bloomberg Law sharing insight on a Court of International Trade (“CIT”) ruling that clears the way for tariff refunds to reach importers whose entries were finally liquidated more than 80 days ago.

Clinton elaborated on the significance of the court’s move, emphasizing that importers in this group will need to take action to benefit from it. “I wouldn’t say this order is surprising, it is certainly significant though,” he said.

“The practical effect is that the CIT is saying that any importers with finally liquidated IEEPA entries will need to seek relief by filing suit at the CIT to receive the benefit of this court order,” Clinton noted.

The decision highlights the importance of evaluating whether tariff entries qualify for relief and understanding the procedural steps required to preserve potential refund claims. Importers affected by the ruling should assess their entries promptly to determine whether additional action before the Court of International Trade is necessary.
