Bill Dombi Quoted in McKnight’s Home Care on DOL’s Authority to Regulate Home Care Worker Pay

Bill Dombi, AGG Healthcare senior counsel, was quoted in a McKnight’s Home Care article examining a recent decision from the United States Court of Appeals for the Sixth Circuit regarding overtime requirements for home care workers.

The ruling addresses the Department of Labor’s (“DOL”) authority under the Fair Labor Standards Act (“FLSA”) to interpret and revise wage and hour regulations, including the companionship exemption. The decision comes as the home care industry awaits further regulatory action that could significantly affect compensation structures across the home care sector.

“It confirms the rulings from the past that the authority in the Fair Labor Standards Act is there for the department to interpret it as it fits for the factual circumstances that exist at the time,” Bill said. “And that’s what the administration is proposing.”
