Alan Horowitz Quoted in McKnight’s Long-Term Care News Titled “Logjam at Top Appeals Board Stymies Efforts to Overturn Steep Nursing Home Penalties”
AGG Healthcare of counsel Alan C. Horowitz was quoted in a McKnight’s Long-Term Care News article discussing a prolonged legal battle involving a Virginia nursing home fined $1.8 million for an alleged safety violation regarding coffee temperatures.
The facility has since pursued an appeal, a process that has now stretched nearly eight years. As with many similar cases, the appeal remains pending before the Department of Health and Human Services’ Appeals Board (“DAB”), which has been managing a backlog of cases, some dating back to 2014. Alan explains that this delay can discourage providers from appealing, given the time, expense, and likelihood of rulings favoring regulators.
