On December 5, 2025, Brian Stimson, AGG Healthcare practice co-chair, will speak on the panel, “Enforcement on Trial: Recent Court Decisions Impacting FDA’s Authority,” during the Food and Drug Law Institute’s (“FDLI”) Enforcement, Litigation, and Compliance Conference: For the Drug, Device, Food, and Tobacco Industries in Washington, D.C. The program will also be held virtually.

The session will examine recent judicial decisions that could significantly reshape FDA enforcement powers, including the Supreme Court’s ruling in SEC v. Jarkesy and its potential application to FDA’s civil money penalty provisions under the federal Food, Drug, and Cosmetic Act. Brian and fellow panelists will also discuss cases such as Loper Bright and FCC v. Consumer Research, with a focus on their implications for FDA enforcement authority and administrative law.
