The Defense Production Act: What Compliance Professionals Need to Know
Tenley Carp, AGG partner and leader of the firm’s Government Contracts practice, authored an article for Compliance & Ethics Professional Magazine discussing how the Defense Production Act (“DPA”) has been utilized historically, why it matters for compliance professionals, and best practices to ensure compliance.
Tenley identified key compliance issues based on the “rated orders” designated as defense priorities by federal agencies, as well as shared the risk posed by the compliance orders and tips on how to specifically comply with each order. She also provided guidance on how compliance professionals can take a proactive approach to DPA-related risk by employing a few compliance program adjustments: related order readiness, contract review protocols, supply chain due diligence, training and communication, and monitoring and reporting.
“In a world where supply chains are fragile, technology is critical, and global threats are ever-evolving, compliance professionals play a frontline role in translating the federal government’s strategic goals into operational reality,” said Tenley. “Understanding the DPA is no longer just a matter of regulatory housekeeping; it is a core competency.”
