AGG partner and Government Contracts practice leader, Tenley Carp, was quoted in a March 9, 2023, article published by The Business Journals titled, “PPP Borrowers Are Facing More Scrutiny From the Feds, Whistleblowers.”
The article states that small-business owners who took Paycheck Protection Program (“PPP”) loans could become the target of False Claims Act lawsuits as the federal government focuses on punishing fraud that occurred in the nearly $800 billion program.
Tenley said these kinds of False Claims Act lawsuits often come from former employees or executives who had more direct knowledge of the company’s internal financials. But it could ultimately be anybody who believes the company was either ineligible for the PPP loan or fraudulently obtained forgiveness for it.
