AGG Healthcare Litigation partner Matt Lavin was quoted in a Law360 article titled “5 Parity Cases Benefits Lawyers Should Watch,” published on September 23, 2022. The article provides an overview of a recent group of lawsuits from patients alleging that insurers violated federal law by skimping on mental health and substance use disorder treatments that hinge on the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 and assert ERISA claims.

The pending cases involving the Parity Act are reflective of how “society is realizing how important it is to have meaningful access for everybody to behavioral health treatment, mental health treatment and substance use disorder treatment,” said Matt. “There’s been a lot of significant successes out there in litigation involving the Parity Act. I think that when you get those kinds of wins, the insurance payers take notice, and they can begin to change their own practices.”

Matt also represents the proposed class in two of the cases highlighted in the article, RJ et. al v. Cigna Behavioral Health Inc. et al. and LD et al. v. United Behavioral Health et al.
