Gabe Scannapieco Quoted in Law.com on the Impact of the Supreme Court's Roundup Ruling
AGG Life Sciences co-chair Gabe Scannapieco was quoted in a Law.com article examining the U.S. Supreme Court’s June 25 ruling that federal law preempted state failure-to-warn claims against Monsanto over its Roundup pesticide — and what the 7-2 decision means for defendants beyond the agricultural sector.
Gabe broke down the majority opinion’s logic and its practical implications for future litigation.
“The majority opinion is pretty straightforward: ‘Hey, this is not in the label, and the statute says you cannot add or change what is in the label.’ Basically, end of story,” he said. “And then it spends the other half of the majority opinion responding to some of the dissent arguments, but then getting back to that key point. It’s not a very difficult argument for defendants to advance in the future. It’s not conceptually complex.”
