Andrew Tsui Quoted in Part B News on New CMS Rule Limiting Medicare Coverage for Certain Noncitizens

AGG Healthcare partner Andrew Tsui was quoted in a Part B News article examining how CMS plans to implement a 2025 law that will remove certain Medicare beneficiaries from the rolls based on immigration status, effective as soon as February 2027.

The article explains that the law, part of the “One Big Beautiful Bill” signed in July 2025, splits Medicare eligibility from Social Security eligibility, limiting Medicare enrollment to four specific categories of residents.

Andrew noted that the consequences of disenrollment extend well beyond Medicare itself. “Losing Part A/B eligibility also cascades into Medicare Advantage, Part D, and cost-plan disenrollment,” Andrew said.

Andrew also discussed CMS’ projection that only a tenth of disenrolled beneficiaries — about 3,200 individuals — will use the special enrollment period available to attain or return to eligible status. “[CMS] calls [3,200] ‘a placeholder assumption [with] no historical precedent’ . . . I’d expect the real number to run higher.”
