Real Estate Litigation

The Real Estate Litigation Practice has broad experience and a history of success in the handling of lawsuits and disputes that concern real estate for banks and other financial institutions, lenders, owners, developers, sellers, purchasers, landlords, tenants, property managers, contractors, brokers and others. The practice provides an exceptional combination of litigation skills and knowledge of this area of law.

Arnall Golden Gregory represents banks and other financial institutions, lenders, owners, developers, sellers, purchasers, landlords, tenants, property managers, contractors, brokers and others with legal issues involving real estate. Our attorneys litigate matters such as the enforcement of loan documents and contracts for the purchase and sale of real property, joint ventures and LLC disputes, foreclosure sale confirmation proceedings and deficiency claims, actions for the partition of land, quiet title actions, statutory dispossessory and distress proceedings, specific performance claims, claims for nuisance and trespass, construction claims and liens, and equitable proceedings for injunctive relief.

In recent years, the Real Estate Litigation Practice has achieved a number of successful outcomes for lenders that have involved the recovery of millions of dollars. In the process, the practice handled significant cases cited as landmark decisions on the issue of whether a lender must proceed under the Georgia statute governing foreclosure sale confirmations prior to initiating an action to recover on defaulted loan documents. The practice also has achieved Super Lawyer recognition for some of its attorneys and has had one of its attorneys selected by the court to serve as a landlord and tenant court judge for a period of time.
