A Long Way to Go: Report Finds Lingering, Hard-to-eradicate Discrimination in Jury Selection

AGG Partner Henry R. Chalmers authored an article titled “A Long Way to Go: Report Finds Lingering, Hard-to-eradicate Discrimination in Jury Selection” for Litigation News, the magazine of the American Bar Association’s Litigation Section. The article reports that racial discrimination in jury selection still flourishes 130 years after the US Supreme Court issues the landmark decision in Batson v. Kentucky prohibiting the use of racially based peremptory strikes, according to findings by the Equal Justice Initiative (EJI), a nonprofit law organization in Montgomery, Alabama. Mr. Chalmers summarizes the results of the EJI study and discusses the advantages and disadvantages of the recommendations suggested by the EJI in its report.
