AGG attorneys Glenn P. Hendrix and Lanchi Nguyen authored the article, “LTCHs Winning Overpayment Claims,” which was published on the Advance for Long-Term Care Management website at www.advanceweb.com. In January 2009, the Centers for Medicare and Medicaid Services (CMS) began seeking overpayments in long-term care hospitals (LTCHs) to recoup the money and establish a payment error rate. These reviews meant that LTCHs must justify care they’ve provided for individual patients as far back as October 2007. The authors discuss how several LTCHs have fought back against these reviews and won, which means that the hospitals will not have to return past Medicare payments and can confidently continue accepting patients and receiving fair Medicare reimbursement.
