Georgia Court of Appeals Affirms Dismissal of Medical Malpractice Action for Insufficient Expert Affidavit

A recent decision of the Georgia Court of Appeals reaffirms the necessity of a qualified expert witness to pursue a medical malpractice action (Hope v. Kranc, 2010 WL 2278353 (Ga. App. June 8, 2010)). The Court of Appeals held that the trial court did not abuse its discretion in determining that the plaintiff’s expert witness had not been engaged in the active practice of the relevant specialty (gynecology or urology) for three of the five years before the operation at issue as required by statute.
