CMS Finalizes National Coverage Determinations (NCDs) For Preventable Surgical Errors

On Thursday, January 15, 2009, CMS announced that it had finalized three NCDs to establish national Medicare payment policies for so-called “never events.”


The following NCDs were issued and are effective immediately:



  • Wrong surgical or invasive procedures performed on a patient; 

  • Surgical or other invasive procedures performed on the wrong body part; and 

  • Surgical or other invasive procedures performed on the wrong patient.
