Class Certification Denied in Data Breach Case

AGG Partner, Henry R. Chalmers, recently authored an ABA Litigation News article entitled, “Class Certification Denied in Data Breach Case.” The article discusses new precedent set in the long-running data breach case, In re Hannaford Bros. Co. Having already established widely-cited jurisprudence on motions to dismiss data breach actions, the court recently denied certification to the proposed plaintiff class, leaving guideposts for future courts to follow in considering motions to certify data breach classes.
