Office Depot/Staples Could See Rare ‘Emergency Stay’ Tactic Deployed – Analysis

Antitrust attorney Jeffrey Jacobovitz, of Arnall Golden Gregory, who represents a third party in the Staples proceeding, said winning an emergency stay pending an appeal would give the Federal Trade Commission (FTC) essentially the same result as obtaining the preliminary injunction. An emergency stay would prevent the companies from closing their merger while the government appeals the judge’s preliminary injunction decision
