AGG Partner Abe Schear was quoted in the May 2010 edition of Entrepreneur magazine and in an article titled, “How to Negotiate a Lease.” The article describes how bargain leases can contain hidden costs and how lessees can avoid them by negotiating contingency plans in their leases. Lease changes to look for include terms of the lease, beginning date of the lease, percentage rent clauses, kickout clauses, co-tenancy agreements, tenant improvements, common area maintenance fees, radius clauses, exclusivity clauses and personal guarantees. Mr. Schear says that it’s important for a lessee not to appear emotionally attached to a property, because it can make negotiating more difficult.
