On February 1, 2016, Jeffrey Jacobovitz will moderate a panel entitled “U.S. v. United Continental : An Examination of DOJ’s Recent Monopolization Suit Over United’s Deal to Acquire Takeoff-and-Landing Rights,” sponsored by the ABA Section of Antitrust Law.
In November, the U.S. Department of Justice filed an antitrust suit against United Continental Holdings to block its acquisition of takeoff-and-landing slots from Delta Air Lines at New Jersey’s Newark Liberty International Airport. This suit claims that United, which already controls 73% of the available slots at Newark, would be able to impose higher fares on passengers if the acquisition went through. This panel will examine the DOJ’s allegations, including whether a single airport can constitute a relevant market if there are other major airports in the area. The panel also will explore United’s possible defenses.
