In In re K-Dur Antitrust Litigation, the Third Circuit, an influential Court of Appeals whose jurisdiction includes Delaware, New Jersey and Pennsylvania, departed from decisions of other Circuit Courts, and loosened the standards for government and private payors to pursue antitrust claims challenging so-called “Pay-for-Delay” settlements.”

On Tuesday, July 31, from 12 pm – 1 pm EDT, AGG will host a complimentary webinar, in which we will offer our insights on the decision, discuss who is at risk, and provide guidance on what pharmaceutical companies can do to brace for the anticipated tide of plaintiffs’ litigation.

Attorneys from AGG’s Antitrust Team, Food and Drug Team and Litigation Practice Group will offer a panel discussion of the current state of the law in this arena, the impact of the circuit split, and the nature of plaintiff lawsuits that the K-Dur decision will likely spawn.
