Stephen M. Dorvee, Partner of the Intellectual Property Team and Alan G. Minsk, Partner and Chair of the Food and Drug Practice Team will discuss some of the legal and regulatory considerations involved with product promotion and recommendations to minimize risk.

You are not paranoid if, indeed, everyone is out to get you.  It certainly seems that everyone is watching today how FDA-regulated companies are promoting and marketing their products.  The Food and Drug Administration, the Justice Department, State Attorneys General, physicians (through the Bad Ad Program), plaintiffs’ lawyers and competitors (through trade complaints,  federal and state false advertising lawsuits or other challenges) are only some of the parties who have taken an active interest.
