The Federal Trade Commission and the Department of Justice have become more aggressive in enforcing antitrust laws that could affect the life science industry. This was illustrated by the FTC v. Actavis case, recently decided by the United States Supreme Court, where the Court held that the rule of reason should be utilized to examine 'pay for delay' type settlements.
