Third Circuit Revitalizes Pay-for-Delay Antitrust Litigation Against Branded and Generic Pharmaceutical Companies

In In re K-Dur Antitrust Litigation, the Third Circuit, an influential Court of Appeals whose jurisdiction includes Delaware, New Jersey and Pennsylvania, departed from decisions of other Circuit Courts, and loosened the standards for government and private payors to pursue antitrust claims challenging so-called “Pay-for-Delay” settlements.”
