Compliance News Flash – June 22, 2018

Arnall Golden Gregory LLP is pleased to provide you with the Compliance News Flash. This weekly update is your source for timely background screening and immigration-related news that is important to your organization.

  1. Listen to my interview on Daily Journal Corp’s latest podcast, “Void for Overlap?,” a podcast about the Connor v. First Student case in California and the constitutionality of California’s Investigative Consumer Reporting Agencies Act versus the Consumer Credit Reporting Agencies Act. These statutes—and their application to background checks in California—are relevant to employers and landlords as is the outcome of this case, which is pending before the California Supreme Court. Click here.

  2. Two items about the Consumer Financial Protection Bureau (CFPB). One, a name change. Out—CFPB; In—BCFP. BCFP stands for the Bureau of Consumer Financial Protection because apparently that’s the actual name of the agency in the enacting legislation. Two, Kathy Kraninger has been nominated to be Director of the BCFP. Ms. Kraninger is a career government official, having worked for the Department of Homeland Security and for appropriations committees in the House and Senate. She currently works at the Office of Management and Budget (OMB). Click here

  3. Massachusetts has been bringing enforcement actions against employers in the Boston-area for alleged violations of the state’s CORI law related to the “ban the box” provision, which prohibits most employers from asking job applicants about a criminal history on an initial employment application. The Attorney General’s (AG) office looked into employers compliance with the state’s “ban the box” law and whether employers were violating the law by asking job applicants on their initial application if they have a criminal record. The AG’s office entered into agreements with Edible Arrangements, Five Guys Burgers and Fries, and L’Occitane as well as sent letters to 17 local businesses warning them to take action to comply with state law. Click here.

  4. If you are a member of the National Association of Professional Background Screeners (NAPBS), my colleagues Kevin Coy and Brad Kelley will be leading a webinar called The Cybersecurity Landscape: Regulatory Issues for CRAs on June 27, 2018 from 3 to 4 pm EST. Login to NAPBS’s website to register. Click here.

  5. ICYMI, Hireright and GIS are merging. Both are providers of background screening and talent acquisition services. The transaction is expected to close during the third quarter of 2018, subject to regulatory approvals and other closing conditions. Click here and here.
