Second Circuit Rules Off-Label Promotion Is Protected Speech: What Does This Mean for Your Company?
AGG Seminars & Webinars
December 17, 2012

On Monday, December 17, 2012, AGG's Food and Drug Practice will offer a complimentary webinar titled "Second Circuit Rules Off-Label Promotion Is Protected Speech: What Does This Mean for Your Company". Last week, the United States Court of Appeals for the Second Circuit issued a ruling that could affect significantly the government’s prosecution efforts in the off-label promotion arena. While the case is limited to those courts bound by Second Circuit decisions and it’s unclear how the government will respond to this judicial loss, AGG Partners William H. Kitchens, Sara M. Lord, and Alan G. Minsk will dissect the decision, discuss its potential broader ramifications case, and examine how enforcement and scrutiny of promotional practices may change. In short, this webinar will explore what this important case means for your company.

Unique insights will be provided by Ms. Lord, who served for 18 years as an Assistant United States Attorney (AUSA) in the Northern District of New York where she was, at various times, the Financial Institutions Fraud Attorney, the Healthcare Fraud Coordinator, and the Professional Responsibility Officer.
