Biography

Scott is a partner in the Real Estate practice and co-chair of the Retail Real Estate team.

Scott focuses his practice primarily on retail, mixed-use, and other real estate projects. His practice centers on the acquisition, development and redevelopment, leasing, management, and disposition of mixed-use projects, regional shopping centers, neighborhood centers, single-tenant buildings, and restaurants. He represents a number of the world’s largest private equity companies, regional, national, and international real estate investment trusts (REITs), entrepreneurial and institutional developers, property owners, managers, and tenants on both a nationwide and local basis.

Experience

  • Represented mall owner in Long Island, New York in converting 250,000 sf mall anchor lease into a synthetic NNN lease and separate tax parcel for sale to third party investor purchaser.

  • Representing developer in development of mixed use project in Midland, Texas including sale of parcel to major oil and gas company for the relocation of its corporate headquarters. 

  • Represented international publicly traded REIT in connection with the lease-up of the multi-billion dollar redevelopments of several ‘fortress-level’ super-regional malls.

  • Represented mall owner in suburban Chicago in renegotiation of existing REA with four major department store owners in connection with transition of property from retail only to mixed use. Included in this project was the parcelization and sale of mall land to one of the largest multi-family developers in the U.S.

  • Representing Noodles & Company, a leading fast casual restaurant chain, currently operating more than 300 company-owned locations, in their continuing national expansion.

  • Represented international owner of enclosed regional shopping malls in the portfolio wide rollout of a major European fashion anchor tenant.

  • Represented landlord, Westfield, in negotiation of a lease an anchor premises to the leading Japanese fast-casual retailer. This was the retailer’s first enclosed mall location in the United States, and is located in one of the top grossing malls in the United States.

  • Represented purchaser in the sale / leaseback of juvenile acute care facility which included a long term care and outpatient components as well as a day care facility.

  • Represented a publicly held, non-traded REIT in the acquisition and leaseback of a large surgical hospital. The transaction involved a recently completed facility and included an option for client to purchase future development.

  • Represented a Fortune 500 consumer goods company in the negotiation of a 1.4 million square foot build to suit regional warehouse and distribution center located in metropolitan Atlanta, Georgia. The facility is used for the storage and distribution of consumer products and regulated chemicals.

  • Led due diligence team for client acquisition of 9 super-regional mall portfolio. The portfolio consisted of over 2 million  sf of in line space and over 30 anchors.

  • Led real estate and loan due diligence teams in representing Australian-based investment fund manager in acquisition of a 49% interest in 8 super-regional malls throughout the United States, valued in excess of $2 billion.

  • Represented The Walt Disney Company in the total redevelopment of Disney Springs [formerly known as Downtown Disney] Orlando, Florida.

  • Represented a multi-branded, publicly traded footwear and apparel retailer in the leasing and management of their real estate portfolio.

  • Represented purchaser of a skilled nursing and assisted living facility in a sale / leaseback transaction including both the operator of the healthcare facility and the local municipality owner of the related property.

  • Representing leading private equity firm in leasing and REIT compliance of multiple office building portfolios.

  • Representing some of the worlds largest private equity firms in the acquisition, redevelopment, disposition, leasing, financing and operation of regional shopping malls.

  • Representing world’s largest sunglass and eyeglass company in the leasing of its North American retail portfolio.
