  • Represent a Salvadorian company in commercial arbitration under UCITRAL Rules against a U.S. distributor.
  • Served as an expert on the issues involving Russian civil and commercial legislation and doing business in Russia.
  • Represented CryoLife, Inc. in federal litigation in Georgia regarding alleged breaches of an international distribution agreement for a medical device.
  • Representing industry leader in the foodservice business, Sysco Corporation (NYSE: SYY), in its domestic and international mergers and acquisitions and corporate structuring matters.
  • Secured the recovery in Russia of funds lost by a financial services company due to a multi-million dollar hacking scheme. The matter required the coordination of parallel criminal and civil proceedings in Russia.
  • Obtained favorable export classification rulings for software company’s products, and successfully represented company on investigation by U.S. government into company’s export control program.
  • Successfully advised U.S. mining original equipment manufacturer (OEM) on developing and securing China-originating  supply chain for drilling products, enhancing global intellectual property protection, building Foreign Corrupt Practices Act compliance programs and policy, and developing international product sales and distribution network.
  • Represented India-based technology company, NIIT (USA) Inc., in its $110 million sale of Element K, an e-learning company, to SkillSoft, and its related strategic partnership with SkillSoft.
  • Successfully represented United States subsidiary of German international construction company in dispute with sub-contractor involving construction of Volkswagen automobile manufacturing plant in Chattanooga, Tenn. Secured advantageous settlement for client.
  • Effectively structured Swedish multinational software company’s China operations.
  • Over a 10 year period represented a major international real estate company in the purchase, sale and financing of real estate with a total transaction value of $8 to 10 billion. Representation included formation, operation and dissolution of joint ventures with regional and super regional shopping center, retail and industrial property owners, and the purchase, financing and sale of office building and industrial properties. The transaction size ranged from approximately $20 million to approximately $325 million, the securitized debt secured by jointly owned shopping center ranged from $70 million to approximately $200 million and conventional bank debt transactions were at various amounts up to $1.6 billion.
  • Represented Austria’s leading provider of aluminum for the manufacturing industry in action on account against South Carolina company regarding non-payment of invoices for shipments of aluminum products. Secured settlement for client.
  • Successfully obtained Article 37 emergency measures of protection before the International Centre for Dispute Resolution, and shortly thereafter, successfully resolved a multimillion dollar controversy between an international manufacturer and an American distributor.
  • Advised leading American provider of land registration and property tax management systems on its operations in Ukraine.
  • Obtained an injunction in Cyprus preserving status quo in connection with a shareholders dispute over the ownership of electric power assets in Ukraine involving court proceedings in Ukraine, Switzerland, U.K. and arbitration under the rules of the London Court of International Arbitration.
  • Secured favorable settlement for minority shareholders of a major Ukrainian ferroalloy plant in an action under the Federal Racketeer Influenced and Corrupt Organization Act (RICO).
  • Advised international investors in all aspects of the acquisition of the ferroalloy and steel assets in the United States including acquisition through receivership and bankruptcy proceedings.
  • Successfully secured stay of the U.S. District Court proceedings in favor of the arbitration under the rules of the London Maritime Arbitration Association.
  • Successfully defended an international consortium, winner of a World Bank contract, against a bid protest action in Ukraine.
  • Advising publicly traded (NASDAQ and German Stock Exchange) multinational software company in U.S. legal matters.
  • Represented German photovoltaic modules manufacturer for setup of U.S. subsidiaries and operation of sales facilities in the U.S.
  • Lead acquisition of multimillion dollar Brazilian and U.S. trade show portfolios by Germany-based trade show company.
  • Secured dismissal of the proceedings in an arbitration claim brought by a Russian coal producer against a U.S. coal trader in the International Chamber of Commerce arbitration in Geneva, Switzerland.
  • Successfully counseled  U.S. telecommunications holding company on $300 million investment by China-based bank into company’s Mexico affiliate.
  • Advising U.S.-based investor in the marketing and sale of $20 million real estate portfolio located in Germany.
  • Represented a Russian company in proceedings under the New York Convention in Seattle, Washington to obtain the recognition and enforcement of an arbitration award rendered by the Moscow-based International Commercial Arbitration Court (MKAS). AGG also collected the resulting judgment, notwithstanding a bankruptcy filing by the respondent that was prompted by the enforcement order.
