Georgia Supreme Court Agrees to Review Healthcare Privacy Case in which AGG Attorneys Filed Brief on Behalf of Georgia Hospital Association

On November 5, 2012, the Georgia Supreme Court granted a Writ of Certiorari to consider whether, in the case of Wellstar Healthcare Inc. v. Jordan, the trial court erred when it granted the plaintiff’s motion to compel the production of transcripts of physician interviews that were conducted ex parte by defense counsel pursuant to a qualified protective order. Jason E. Bring and Erin R. Kendall filed an amicus brief on behalf of the Georgia Hospital Association in support of Wellstar’s request for the Court to protect the work product doctrine and to provide guidance to litigants regarding the interplay between the doctrine and HIPAA.
