Arnall Golden Gregory’s False Claims Act Defense Practice has successfully defended healthcare providers, pharmaceutical companies, and other government contractors for decades in investigations and prosecutions for violations of the Anti-kickback statute and the False Claims Act, and Medicare and Medicaid fraud.  We are highly experienced in defending corporations against these sensitive and confidential qui tam or whistleblower claims, having successfully defended dozens of qui tam claims litigated against our clients by the Department of Justice in jurisdictions across the country. 

Many members of AGG’s False Claims Act Defense Practice have years of experience in federal health care enforcement. Our ranks include a number of former Assistant United States Attorneys (“AUSAs”), a former Senior Deputy Attorney General, and a former senior officer of the Centers for Medicare & Medicaid Services (“CMS”). In addition to their direct government experience, AGG attorneys have worked closely with government enforcement agencies to resolve dozens of inquiries, investigations and settlements. Through this work, they have built a strong rapport with the DOJ, OIG, CMS, state Medicaid Fraud Control Units, and other government agencies. Over the past 25 years, we have successfully handled and resolved dozens of government investigations and False Claims Act cases throughout the country, including in Georgia, Florida, Alabama, Massachusetts, Pennsylvania, South Carolina and Texas.

We understand that in today’s stringent regulatory environment, the best defense is a strong corporate compliance culture to affirmatively prevent False Claims Act cases. Accordingly, our attorneys are helping our clients protect themselves by strengthening their internal compliance programs. This includes incorporating a culture of compliance throughout the company, making reporting procedures readily accessible to employees, protecting privileged communications from misuse, and making sure that legitimate employee reports are investigated promptly and, if necessary, addressed quickly. We have extensive practical experience in developing and implementing individually-tailored compliance programs for the broad spectrum of clients we represent. AGG provides related training and monitors and audits the programs to ensure their efficacy in regulating the healthcare payment and delivery systems. We also have substantial experience in advising and working closely with clients on complex self-disclosure issues, audits and investigations. We often assist clients in the negotiation and implementation of, and compliance with, Corporate Integrity Agreements.
