Overview

Our Private Wealth practice attorneys represent the interests of fiduciaries or beneficiaries where adversarial relationships exist in the estate or trust administration process. Our first goal is to assist clients in resolving their differences without resorting to the litigation process. In doing so, we draw on their experience in mediation and arbitration. Unfortunately, some matters are not subject to amicable resolution. Therefore, when litigation is necessary, our estate litigation attorneys bring expertise to bear in representing the interests of fiduciaries and beneficiaries in such matters as will construction suits, will contests, estate controversies, and other litigation which arise in the context of estate and trust administration.

We bring a cross-disciplinary approach whereby lawyers with deep expertise in estate administration are paired with highly experienced litigators to form a powerful and effective team for the benefit of our clients.

Experience

  • Obtained a jury verdict in the United States District Court for the Northern District of Georgia for $3.5 million on a conspiracy to defraud client and her children of assets from the estate of her grandfather (the children’s great grandfather). Judgment was affirmed on appeal by the 11th Circuit Court of Appeals. After the defendant began to hide assets to avoid collection of judgment, filed a RICO suit against defendant and his trust which was settled for more than the original judgment.
