Amicus Brief - Georgia Supreme Court case O'Kelley v. Perdue

Scott Titshaw filed an amicus brief on behalf of 55 Georgia law professors in the Georgia Supreme Court case of O'Kelley v. Perdue, an appeal of the Fulton County Superior Court decision striking down a state constitutional amendment as a violation of Georgia's centuries-old single-subject requirement regarding the way amendments may be presented to voters. The amendment in question defined marriage, prohibited recognition of judgments from other states related to same-sex marriages, and prohibited legal recognition of same-sex couples through civil unions or any of the rights and benefits associated with marriage. The ballot language referred only to an amendment defining marriage as the union of a man and a woman. The Supreme Court heard the case on June 27, 2006, and is expected to reach a decision before August 7, 2006.
