Loan Workout Team

The Loan Workout Team is an inter-disciplinary team of over 15 attorneys from complimentary Arnall Golden Gregory practice areas, including Institutional Lending, Bankruptcy, Creditors' Rights and Workout, Litigation, and Corporate. The Loan Workout Team focuses on the representation of banks, finance companies, insurance companies and other lenders in all aspects of loan workouts, including collateral reviews, loan modifications, loss prevention, debt restructuring, loss minimization, bankruptcy financing, debtor-in-possession financing, and Chapter 11 exit financing.

The Loan Workout Team was formed to handle problem or non-performing loans through all phases of the loan workout process, without the necessity of shifting the files among various departments. The process begins by auditing the existing collateral files to assure that the lender has appropriate documentation evidencing and securing the collateral. Our team then works with lenders to:

  • Restructure loans
  • Provide advisement as to potential lender liability or environmental issues
  • Document loan modification and forbearance agreements
  • Conduct foreclosures of real and personal property
  • Provide pre-bankruptcy strategic planning
  • Represent creditor in bankruptcy and other court proceedings
  • Suggest ways to maximize yield by providing debtor-in-possession financing.

By bringing the Loan Workout Team onboard as soon as a loan is downgraded or transferred to a bad loan or special asset department, lenders are able to minimize any potential loss.

The following are examples of some loan workout transactions handled during the fall of 2001:

  • Representation of a regional bank in workout, asset liquidation and sale of audio component manufacturer as a "going concern" in connection with multi-facility industrial revenue bond construction financing transaction.
  • Representation of a large financial institution in connection with a subsidiary borrower loan workout and pre-bankruptcy strategic planning, with regard to unsecured line of credit to a retail grocery chain guaranteed by publicly traded guarantor owners.
  • Representation of a creditor in loan workout and multi-state liquidation of collateral of a large discount auto parts dealer.
  • Representation of a regional bank in loan workout and non-bankruptcy liquidation of a fiber optic cable installation company.
  • Representation of a regional bank in workout of a term revolving debt to private individual secured by investment real estate.
  • Representations of a regional bank in regular loan workout, modification and forbearance transactions relating to revolving debt and term loans to manufacturing concerns.
