Biography

David is of counsel in the Litigation, Healthcare, Antitrust, and Government Investigations practices. He is the chair of the eDiscovery practice. David’s well-developed litigation practice focuses on complex business disputes for companies of all sizes. His clients come from many industries, including healthcare, logistics, insurance, food services, and others.

David is well-known for his deep experience in eDiscovery matters. He advises on information governance and is particularly adept at negotiating eDiscovery protocols designed to ensure that electronic discovery proceeds in a manner that is both efficient and proportional. He also oversees the preservation, collection, and production of electronically stored information. His clients and colleagues praise his practical, cost-effective guidance when it comes to even the thorniest eDiscovery issues.

In addition to his eDiscovery experience, David maintains an active antitrust practice, counseling his clients on any number of antitrust issues and representing clients in antitrust litigation. He also represents business clients in commercial disputes and healthcare companies in False Claims Act investigations and litigation.

Experience

  • Obtained favorable settlement for four former employees of the nation’s largest provider of building HVAC controls, equipment, and services, including successfully moving to dismiss claims based on employee restrictive covenants found by the court to be unenforceable under Georgia law.

  • Representing Zurich Services Corporation, the risk services subsidiary of Zurich American Insurance Co., in mass tort litigation arising from one of the worst industrial disasters in Georgia.

  • Obtained a multi-million dollar verdict for an Atlanta-area hospital against one of its service providers in a federal court jury trial.

  • Serves as national eDiscovery counsel for large healthcare companies with respect to both civil litigation and governmental investigation matters.

  • Represented CryoLife, Inc. in federal litigation in Georgia regarding alleged breaches of an international distribution agreement for a medical device.

  • Obtained favorable settlement for Air Lite in contract dispute against Airgas and Linde Gas, two large, multinational distributors of industrial gases.
