Frank N. White has been practicing law since 1989, and is a partner in the firm's Bankruptcy, Creditors’ Rights and Workout Practice Group and Litigation Practice Group. Mr. White's practice encompasses a broad range of bankruptcy, litigation and intellectual property matters.
 
In the bankruptcy area, Mr. White concentrates on creditors’ rights under the Bankruptcy Code, with an emphasis on issues relating to public utilities and counterparties to executory contracts. Issues frequently arising in his bankruptcy work include the securing of deposits, pre-payments and other adequate assurance of future performance from extremely high-volume utility service customers, the curing of contract defaults when a debtor assumes and/or assigns its assets to a purchaser, responding to claim objections filed by debtors, and the handling of myriad types of adversary proceedings arising out of bankruptcy cases. Mr. White’s recent bankruptcy representations include serving as counsel to one of the largest trade creditors in the bankruptcy case of Lehman Brothers Holdings, Inc., pending in New York, New York; serving as counsel to one of the largest commercial customers in the bankruptcy case of Circuit City Stores, Inc., pending in Richmond, Virginia; serving as counsel to one of the largest trade creditors in the bankruptcy case of Lucre, Inc., pending in Grand Rapids, Michigan; as well as litigating complex jurisdictional, procedural and legal issues in two related adversary proceedings.
 
Mr. White’s experience also covers the entire spectrum of general, commercial litigation, with an emphasis on contract disputes, copyright, trade secret and other intellectual property issues. For example, Mr. White has successfully prosecuted and defended copyright infringement actions involving computer software, photographs and musical compositions. Mr. White has also handled litigation matters involving breach of contract issues, business torts, non-compete covenants, fraud, libel, constitutional claims and defenses, and a host of other business-related issues.
 
Mr. White also does both litigation and transactional work in the area of entertainment law, with an emphasis on issues relating to the music business and the use of music in film, television and other media. Mr. White’s entertainment clients include recording artists signed to major and independent record labels, unsigned artists, songwriters and composers, filmmakers, producers and recording studios, two independent record labels, an independent music retailer and a national association of independent media stores. Mr. White also serves pro bono as intellectual property counsel to The Center for Puppetry Arts, and recently assisted in its acquisition of items from the Jim Henson Foundation collection. Mr. White also represents authors in the negotiation of contracts with literary agents and publishing houses.
