Mr. Desai is an associate of the firm in the Litigation Practice Group, and a member of the Intellectual Property Team and Cross-Border Team. He counsels clients in the areas of litigation, dispute resolution, trademarks, copyrights, licensing, and technology agreements. Prior to joining the firm, Mr. Desai was an e-commerce and CRM business consultant for a “Big 5” consulting firm, and subsequently an eBusiness application architect for a multinational document management company.

Litigation
  • Representing a state agency in a multi-million dollar breach of contract lawsuit involving an unsuccessful software implementation
  • Representing a drug company in a false advertising lawsuit (Lanham Act) brought against a competitor
  • Representing an author in a publishing agreement and copyright dispute
  • Obtained favorable settlement for a consumer products company in its lawsuit against a counterfeiter, including an ex parte seizure of counterfeit goods
  • Obtained favorable settlement for a national truck dealership in a contract dispute involving the United Nations Convention on International Sale of Goods
  • Obtained favorable settlement for courier company in a Lanham Act lawsuit brought against competitor for false advertising and domain name misuse
  • Obtained favorable settlement for a marine products company in Lanham Act lawsuit involving trademark infringement through web site meta tags and Google AdWords
Transactional
  • Counseled German software company as to barriers to entry to U.S. market, including analysis of patent landscape
  • Drafted agreement protecting healthcare group’s intellectual property as to its participation in a clinical trial
  • Drafted agreement for software company to protect its intellectual property and trade secrets when hiring third-party contractors
